RECOMMENDED CITY COUNCIL ACTION:      
·      City Staff recommends approval of the proposed changes to the noise ordinance.
 
ITEM SUMMARY:  
·      Based on a previous Work Session discussion regarding noise complaints in Downtown McKinney staff has prepared a revised noise ordinance.
·      Consistent with Council direction outdoor amplified music will be allowed until 10:00 PM in an area generally defined as Downtown McKinney.
·      Acoustic, non-amplified music will be allowed outdoors until 11:30 PM.
·      Additionally, outdoor speakers are only permissible if the source of the noise is also outside.
·      Staff has shared a summary of the revisions with Downtown businesses through the City's Main Street Program and received very limited feedback.
 
BACKGROUND INFORMATION:  
·      On November 17, 2014, City Council discussed complaints received regarding noise from restaurants and music venues in Downtown.
·      In that meeting, City Council reached a consensus on revising the noise ordinance to limit music in Downtown McKinney to acoustic, non-amplified noise after 10:00 PM.
·      On February 23, 2015 City Staff shared the ordinance with the City Council in its current state, and received feedback requesting that business owners be informed with enough time to provide input and make alternate arrangements if necessary.
·      Following that meeting, City Staff provided a summary of the proposed revisions to the Downtown business owners through the Main Street Director.
·      Additionally, the proposed changes were discussed at the monthly Downtown Businesses meeting hosted by the City's Main Street program on March 10, 2015.
