RECOMMENDED CITY COUNCIL ACTION:
* Approve the proposed boundary agreement

ITEM SUMMARY:
* The property owner of approximately 16.482 acres of land within McKinney's Extraterritorial Jurisdiction (ETJ) has requested that their property be removed from McKinney's ETJ and placed in the Town of Fairview's ETJ due to the inability to serve the property with McKinney utility services.

* In order to modify the boundary between the City of McKinney and the Town of Fairview, the City Council must approve and authorize the execution of a modified boundary agreement placing the subject property into the Town of Fairview's ETJ and removing it from the City of McKinney's ETJ.

* The subject property does not currently have access to City of McKinney water and sanitary sewer services. The extension of these services to the property is problematic due to its location between the Heard Natural Science Museum and properties located within the Town of Fairview. Acquiring easements through the adjacent private properties would be extremely costly and extremely detrimental to those properties and placing utility lines within the right-of-way is not possible due to limitations imposed by TxDOT. The extension of this water and sanitary sewer infrastructure would only serve the property and would not benefit any other properties in the area.
