RECOMMENDED CITY COUNCIL ACTION:

ITEM SUMMARY:
· This Resolution authorizes the City Manager to execute a supplemental agreement with Brown & Gay Engineers, Inc, for additional engineering design services required for the US 75 Utility Relocation Project from SH 121 to White Avenue, for a revised total fee not to exceed $815,000.

BACKGROUND INFORMATION:
· A professional services contract with Brown and Gay Engineers was authorized by City Council on June 1, 2010 for the design of the US 75 Utility Relocation Project from SH 121 to White Avenue, for an amount not to exceed $706,000.
· During the course of design and construction of this project the following issues were encountered that require additional design work.
- Additional design services were needed to account for unforeseen field conditions and corrections to right-of-way information provided by TxDOT.
- Design changes needed to avoid the acquisition of a potentially costly easement at the northeast corner of US 75 and Greenwood Road. At this location, the initial plans called for an existing sewer main to be relocated into an easement across the frontage of that property. After easement negotiation was initiated the acquisition team recognized the acquisition cost would likely be very high. At that point alternative design options were developed and because the right-of-way did not have any franchise utility conflicts, an alternative route for the sewer main was found on the right-of-way eliminating the need for the easement.
