RECOMMENDED CITY COUNCIL ACTION:      
·      Adopt Resolution approving a Settlement Agreement between the City of McKinney and Wilburn Tucker and authorizing the City Manager to execute the Agreement
 
ITEM SUMMARY:  
·      In September of 2009, Mr. Tucker, who was on the City's employee health plan, was involved in a vehicular accident that resulted in injuries.  
·      Mr. Tucker has now reached settlement with responsible party.
·      The City sought to subrogate a portion of that settlement.
·      The City has tentatively reached a Compromise Settlement Agreement for employee benefits subrogation in the amount of $10,000 as well as the release of all claims.
·      City Council approval is required in this instance as the Agreement includes a release of claims.
·      Agreement was negotiated by TML-IEBP (our benefits administrator) and reviewed by City Attorney Mark Houser
