Summary
The City Secretary shall examine a filed recall petition for sufficiency and compliance and submit findings to the City Council in accordance with Section 146 of the Charter.

ITEM SUMMARY:
* On December 27, 2019, the City Secretary's office received a recall petition pursuant to Section 145 of the McKinney Home Rule Charter. The Charter requires an examination thereof for sufficiency and compliance with the Charter and state law. If the City Secretary certifies that the petition is sufficient and compliant, the City Secretary shall notify the officer (elected official) of said certification, and the City Council shall order a recall election at its next regular meeting if the officer has not resigned within five (5) days from receipt of notification by the City Secretary.
BACKGROUND INFORMATION:

The City Secretary shall at once examine the recall petition and, if the City Secretary finds it sufficient and in compliance with the provisions of this Chapter of the Charter, the City Secretary shall within five (5) days or at the next regular City Council meeting, whichever is later, submit it to the City Council with its office's certificate to that effect and notify the officer sought to be recalled of such action.
If the officer whose removal is sought does not resign within five (5) days after such notice, the City Council shall thereupon order and fix a date for holding a citywide recall election according to State law.
