RECOMMENDED CITY COUNCIL ACTION:                     

                     Approve the ordinance.

 

ITEM SUMMARY: 

                     At the City Council’s regular meeting on September 7, 2021, the City Council adopted a resolution, number 2021-09-112(R) which is attached hereto, establishing a policy governing public improvement districts (PID).

                     This policy established an application fee to cover staff costs associated with reviewing a proposed public improvement district and a cash deposit which could be used to cover the City’s costs associated with retaining third-party consultants to evaluate a proposed public improvement district.

                     However, to assess and collect the fees outlined in the approved PID policy, a fee ordinance must also be approved by the City Council.

                     The proposed fee ordinance includes two fees:

o                     Public Improvement District (PID) Application Fee:

§                     $50,000.

o                     Public Improvement District (PID) City External Evaluation Deposit:

§                     $200,000 shall be paid by the PID petitioner so that the city may retain external consultants to assist in the evaluation of a proposed PID. Additional deposits of $200,000 may be required as determined necessary by the city if the initial $200,000 deposit is depleted and the PID’s evaluation is still ongoing.

                     The proposed fees are consistent with the fees referenced within the adopted PID policy.

                     Depending on the level of services provided, the proposed fees will increase revenue to offset staff and consultant costs.
