RECOMMENDED CITY COUNCIL ACTION: Conduct the third of three public hearings regarding a voluntary petition for annexation.

* In accordance with the Texas Local Government Code, the City Council held the first public hearing at a special meeting on August 18, 2014 (5:30 p.m.) and held a second public hearing at a regular meeting on August 19, 2014 (6:00 p.m.). This is the final public hearing for action regarding the petition for annexation, and it is being considered concurrently with an associated zoning request (14-145Z) and a developer's agreement.

ITEM SUMMARY:

* The applicant has submitted a petition for voluntary annexation to the City of McKinney for an approximately 29.02 acre tract of land. The subject property is located approximately 1,900 feet north of Eldorado Parkway and on the east side of Custer Road.

* The subject property, if annexed, will be zoned pursuant to a pending zoning case (14-145Z) that will be considered concurrently at the September 16, 2014 City Council meeting. The associated zoning request will cover the same land area as contained within the annexation petition.

* Staff is unable to support the annexation request as the associated zoning request is not in conformance with the City's Comprehensive Plan with regard to minimum mean and median lot sizes and maximum density.
