RECOMMENDED CITY COUNCIL ACTION:
· Approval of the Ordinance.

ITEM SUMMARY:
· This Ordinance abandons approximately 0.285 acres located on the west side of Lake Forest Drive south of US 380 with the following conditions:
o The City of McKinney reserves an exclusive, utility and drainage easement within the entirety of the abandoned right-of-way.
o The owner of the Rose Tract dedicate 0.284 acres of right-of-way along the south side of US 380 as shown on Exhibit B.
o The owner of the Rose Tract dedicate 0.013 acres on Lake Forest Drive as shown on Exhibit A.

BACKGROUND INFORMATION:
· The acquisition of the right-of-way necessary for the construction of Lake Forest Drive south of US 380 created a narrow strip of land located west of and outside of the area necessary for Lake Forest Drive.
· The remainder strip was of little value to the original property owner (located east of Lake Forest Drive); therefore, the City of McKinney included the strip of land as part of the acquisition.
· During the review of the development plans for the Rose Tract, located at the southwest corner of the intersection of US 380 and Lake Forest Drive, it was determined that the subject strip of land should be abandoned by the City in exchange for the following two pieces of the Rose Tract:
o A strip of land along the south side of US 380 needed for the construction of a right-turn lane for eastbound traffic.
o A small portion of land along Lake Forest Drive as shown on Exhibit A.
