RECOMMENDED CITY COUNCIL ACTION: Staff recommends denial of the proposed rezoning request due to a lack of conformance with the Comprehensive Plan.
However, if the rezoning request is to be approved, the following special ordinance provisions shall be applicable:
1. The use and development of the subject property shall conform to the regulations of Section 146-73 (“RS 60” - Single Family Residence District) of the Zoning Ordinance, and as amended, except as follows:
a. The subject property shall generally develop in accordance with the attached Zoning Exhibit.
b. The subject property shall be subject to the attached development regulations.
ITEM SUMMARY:
· The applicant is proposing to rezone approximately 65 acres of land, located on the west side of McDonald Street (State Highway 5) and approximately 1,400 feet north of Wilmeth Road, from “AG” - Agricultural District to “PD” - Planned Development District, generally to allow for single family residential uses and to modify the development standards.

SPECIAL CONSIDERATIONS:
· At the February 14, 2012 Planning and Zoning Commission meeting, there was a fair amount of discussion amongst the Commission members regarding the approximately 100 acres of undeveloped City owned land located to the west of the subject property being developed as a City park in the future. ...
