RECOMMENDED CITY COUNCIL ACTION:                     

                     Approval of the ordinance consenting to the annexation of a 3.055 acre tract into Municipal Utility District No. 1 (Trinity Falls).

 

ITEM SUMMARY: 

                     Municipal Utility District No. 1, also known as Trinity Falls, has petitioned for City consent to the annexation of a 3.055 acre tract into the district.

                     The previously approved development agreement between the City of McKinney and Trinity Falls provides the City’s consent to annexations by the district. 

                     This agenda item is to approve an ordinance providing formal City consent to the subject property’s annexation into the MUD district.  This formal consent is necessary for obtaining state approval.

 

BACKGROUND INFORMATION: 

                     The annexation of land into the district does not increase the total number of residential units permitted by the development agreement.

                     The property being annexed into the MUD district is the northern portion of the property containing the existing Grayson-Collin Electric Cooperative (GCEC) substation.

                     Texas Water Code, Section 54.016, as amended, provides that no land within the corporate limits of a city or within the extraterritorial jurisdiction of a city, shall be included within a municipal utility district unless such city grants its written consent, by resolution or ordinance, to the inclusion of the land within the district.
