ITEM SUMMARY:
· This item authorizes the City of McKinney to enter into an agreement with Beazer Homes Texas, L.P. regarding the maintenance and monitoring of a detention pond.
· The Detention Pond Maintenance and Monitoring Agreement is attached herewith.
· Beazer Homes, L.P. has built and is responsible for the maintenance of the existing detention pond in accordance with the City of McKinney Storm Water Drainage Ordinance.
· Beazer will maintain and repair the detention pond until such a time as Beazer creates a Homeowner's Association (HOA) and assigns its obligations under the easement to the HOA.
BACKGROUND INFORMATION:
· The drainage and detention pond was designed and built in accordance with the City of McKinney Storm Water Drainage Ordinance.
· The City requires that storm water management facilities be constructed and adequately maintained by a responsible party.
FINANCIAL SUMMARY:
· The maintenance and monitoring cost will be the responsibility of Beazer and its assignees.
