ITEM SUMMARY:
This Resolution:
Authorizes a contract amendment of $150,000 with Pogue Construction, the Construction Manager for the McKinney Tennis Complex, located at 3253 Alma Road.
Establishes a revised not to exceed contract sum of $3,376,665 as proposed by Pogue Construction.

BACKGROUND INFORMATION:
The previous agreement executed in May 2011 established a guaranteed maximum price of $3,235,224 which was reduced by project savings of $8,559 to $3,226,665.
Revisions to the existing walls along with the addition of fencing are proposed for the tournament court area.
Pogue Construction has compiled the bids for the additional scope of work and has submitted a contract amendment of $150,000 for approval.
With this approval, Pogue Construction will be notified to begin construction with completion scheduled for June 2013.

FINANCIAL SUMMARY:
A budget amendment is being proposed concurrently with this item to provide $100,000 supplemental funding that coincides with the $150,000 contract amendment in the Capital Improvements Program in PK5029; the remainder of the funding is provided by project savings.
The Resolution authorizes a contract for Pogue Construction for an amount not to exceed $3,376,665.
