RECOMMENDED CITY COUNCIL ACTION:      
·      Approval of the Resolution
 
ITEM SUMMARY:  
·      This resolution authorizes the Interim City Manager to enter into an operations and maintenance agreement with the USDA-NRCS and the Collin County Soil and Water Conservation Service for East Fork above Lavon Floodwater Retarding Structure Site 2A.
 
BACKGROUND INFORMATION:  
·      This fully executed agreement is required to obtain funding ($3,012,750) from the USDA-NRCS for the rehabilitation of East Fork above Lavon FRS Site 2A.
·      The City accepts maintenance responsibility after the rehabilitation of the floodwater retarding structure, which is anticipated to be August of 2016 based on the previously executed project agreement.  
·      The NRCS FRS's are considered to be a part of the City's drainage infrastructure requiring maintenance similar to all other portions of the City's infrastructure.  
·      The agreement defines the City's responsibilities for inspecting, operating, and maintaining Site 2A upon rehabilitation.   
·      There is a sinking fund ordinance providing for the funding of these O & M activities also on this agenda.  
 
FINANCIAL SUMMARY:  
·      The NRCS estimated an operations and maintenance cost to the City of $3,500 per year.
