RECOMMENDED CITY COUNCIL ACTION:
* Approval of the Agreement

ITEM SUMMARY:
* This item authorizes a pass through agreement between the City of McKinney, North Collin Water Supply Corporation (NCWSC) and CH-B Trinity Falls LP (Trinity Falls) regarding water service during the early phases of development at Trinity Falls.
* A companion cooperative service agreement between North Texas Municipal Water District (NTMWD), the City of McKinney and NCWSC is also on this agenda.
* These two agreements would have been combined, but NTMWD only wanted to enter into agreements with their member and customer cities.
* This pass through agreement essentially states NCWSC will provide the City of McKinney water at a point at the Trinity Falls development as shown on the attached exhibit. In addition, the agreement spells out the responsibilities of Trinity Falls with respect to the construction of the connections.
* A master water meter coming off the NCWSC system will be placed at the entry to Trinity Falls. The meter and associated piping installation is the responsibility of Trinity Falls.
* All water passing from NCWSC to Trinity Falls will be recorded at the master meter. At and after the meter, the pipes and flow will be part of the City of McKinney's water system once accepted by the City.
* In order for NTMWD to appropriately bill the City of McKinney for the water serving Trinity Falls, that master-metered flow will be read and provided to NTMWD as part of McKinney's water usage.
