RECOMMENDED CITY COUNCIL ACTION: 

                     Staff recommends approval of the proposed ordinance.

 

ITEM SUMMARY: 

                     Section 62-620 of the Code of Ordinances currently defines a vehicle to be a “Junked Vehicle” if it does not have both (i) an unexpired license plate, and (ii) a valid motor vehicle inspection certificate.

                     Staff proposes that due to changes in state law, these regulations be modified so that vehicles must only have valid proof of current registration.

 

BACKGROUND INFORMATION:

                     The City’s Junked Vehicle Ordinance was adopted in 1999. At that time, the State of Texas required each vehicle to have a registration decal and an inspection decal displayed on it, both of which decals were required to be renewed on an annual basis.

                     In 2013, H.B. 2305 eliminated the requirement to display an inspection sticker, which resulted in a single-sticker system making vehicle registration dependent on obtaining a passing vehicle inspection.

                     The proposed amendment will align the City’s definition of a “Junked Vehicle” set out in the “Motor Vehicles and Traffic” Ordinance with those changes.
