RECOMMENDED CITY COUNCIL ACTION:
• Approval of Resolution.
ITEM SUMMARY:
• This Resolution authorizes the City Manager to enter into a Project Agreement with the TSSWCB to receive federal funding to rehabilitate the dam at USDA NRCS EFAL FRS Site 4, aka Brinkmann Ranch Lake.
• The Project Agreement specifies that the City of McKinney will construct the project and receive quarterly reimbursements from the TSSWCB for 65% of the overall cost.
• The Project Agreement is funded by the NRCS through a separate agreement between the TSSWCB and the NRCS.
BACKGROUND INFORMATION:
• This rehabilitation project is authorized under the authority of Public Law 106-472, the Small Watersheds Rehabilitation Amendments of 2000, which amends Public Law 83-566, the Watershed Protection and Flood Prevention Act.
• In recent years, the City of McKinney has rehabilitated eight similar dams including 1A Walnut Grove Lake, 2A Highland Lake, 2B Summit View Lake, 3C Mallard Lake, 3D Turrentine Lake, 3E Provine Lake, 5A Eldorado Lake, and 17 Bloomdale Lake.
• The dam is located north of US 380 between Lake Forest Drive and Hardin Boulevard. It is known locally as Brinkmann Ranch Lake. The Site 4 dam does not meet current safety standards. A failure of the dam would result in potential loss of life and significant property damage.
• After the rehabilitation project is complete, the City of McKinney will assume operation and maintenance responsibility for the dam.
FINANCIAL SUMMARY:
• As specified in this Project Agreement, the TSSWCB will provide 65% of the funding for this project. This funding is being provided to the TSSWCB by the NRCS by a separate agreement between the TSSWCB and the NRCS.
• The TSSWCB prefers at this time to show in the Project Agreement $0 for the estimated construction cost, then amend the agreement with the actual construction cost after the bid opening.
• The estimated cost breakdown is as follows:
Construction: $ 5,000,000
Land Rights Acquisition: $ 500,000
Contract Administration: $ 40,000
Total Cost: $ 5,540,000
• Therefore, this TSSWCB grant is estimated to be for $3,601,000 (65% of $5,540,000).
• This is one of two grants being considered for approval at this meeting. The other is also from the TSSWCB, however, it is for state funding. The state is providing 33.25% of the overall project cost. The two grants combined will provide 98.25% of the overall funding for the project.
• If both grants are approved, the City cost for this project will be approximately $95,375 (1.75% of the overall project cost).
• As previously authorized in the CIP budget, the City has $2,041,816 available in DR5039 for this project, most of which is not needed if both grants are approved.
• The NRCS estimates the City cost for operation and maintenance to be $2,800 annually.
• Numbers shown here are estimates only. However, the Resolution allows the City Manager to amend the agreements as needed to account for actual costs.
