RECOMMENDED CITY COUNCIL ACTION:                     Approve Resolution

 

ITEM SUMMARY: 

                     This item allows the City Manager to execute a second amendment to the tennis services management agreement.

                     The existing agreement was originally executed in 2012.

                     In 2015, a first amendment to the agreement was approved by the City Council.

                     The first amendment articulated with more clarity the terms of the agreement including timelines and termination dates.

                     The first amendment also allowed for one initial five-year term with two, five-year renewal options.

                     A second amendment to the agreement is required to exercise the renewal options.

                     The existing contract expires on February 2, 2017.

                     Approval of a second amendment to the agreement is proposed which will allow the City Manager to exercise the first, five-year renewal option.

                     The attached resolution allows for a second amendment to the agreement and authorizes the City Manager to exercise the first renewal option extending the agreement to February 2, 2022.

                     One renewal option of five years will remain.

 

BACKGROUND INFORMATION:

                     The original agreement was executed with Lifetime Tennis Inc., a Texas corporation on February 3, 2012.

                     City staff and representatives from Lifetime Tennis Inc. met to discuss the desire to extend the contract for an additional five years.

                     Both are in support of the contract renewal.

                     Staff is extremely pleased with the quality of services provided.

                     The proposed amendment has been approved to form by legal counsel.
