RECOMMENDED CITY COUNCIL ACTION:                     

                     Provide direction regarding the need for amendments addressing maximum fence heights in the Historic District Overlay.

 

ITEM SUMMARY: 

                     Council Members Day and Ussery requested that an item be placed on the work session to discuss maximum fence heights in the Historic District Overlay.

 

                     Staff is seeking direction from the City Council regarding whether or not amendments to Chapter 122 of the Code of Ordinances which would modify the maximum fence height for properties within the Historic District Overlay should be drafted for consideration and adoption.

 

                     Concerns have been vocalized recently regarding the Historic District Overlay’s limitation on fence heights of 6’8”. Properties outside this overlay district are permitted to construct fences of at least 8’6”. Industrial properties are permitted to construct fences that are 10’ in height.

 

                     Two main concerns regarding the existing fence height limitations in the historic district have been expressed:

 

o                     The regulations negatively impact residential properties who abut non-residential properties in the historic district who may otherwise wish to provide more privacy for the adjacent residents and potential customers.

 

o                     The regulations limit residential property owners’ rights to privacy and security by limiting fence heights to a level that’s inconsistent with the heights allowed outside the historic district.
