RECOMMENDED CITY COUNCIL ACTION:
• Approval of the Resolution.
ITEM SUMMARY:
• This item is to consider a preferred approach for municipal annexations for the remainder of 2017.
• Staff has identified four potential approaches for municipal annexations for the remainder of 2017, which include:
o Option A: do not conduct municipal annexations in 2017
o Option B: conduct municipal annexations in support of specifically identified roadway and bridge improvement projects
o Option C: conduct municipal annexations in support of identified roadway, water and sewer improvement projects
o Option D: conduct municipal annexations in alignment with anticipated growth corridors and development pressures
• In order to carry out the desired municipal annexation proceedings for 2017, Staff is requesting formal direction from the Council regarding the preferred annexation approach.
BACKGROUND INFORMATION:
• During the 85th Legislative Session, the Texas Legislature approved Senate Bill 6 which amended Chapter 42 of the Texas Local Government Code regarding municipal annexations in Texas.
• Among other things, the changes to Chapter 42 of the Texas Local Government Code severely limit the ability of Texas municipalities to carry out municipal annexation proceedings.
• These new changes in State Law will go into effect on December 1, 2017. Annexations completed prior to December 1, 2017 may be carried out under the existing provisions of the Local Government Code.
