RECOMMENDED CITY COUNCIL ACTION:                     Approve Ordinance.

 

 

ITEM SUMMARY: 

                     On January 22, 2018, the City Council discussed the possible late night sales of alcoholic beverages and directed staff at that time to bring back an Ordinance establishing the late night hours for alcohol sales.

 

                     This Ordinance will allow holders of certain permits for on-premise consumption the ability to sell alcoholic beverages until 2:00 a.m. every day.

 

                     This Ordinance also amends the Schedule of Fees to clarify the wording on all alcohol permit fees.

 

BACKGROUND INFORMATION: 

                     City Staff has been approached by developers requesting that the City allow the sale of alcoholic beverages between midnight and 2:00 a.m. every day to encourage more restaurants to locate in McKinney.

 

                     The City’s regulation of alcoholic beverages is preempted by state law.

 

                     Alcoholic Beverage License or Permit Holders for on-premise consumption (“Permittees”) may currently sell alcoholic beverages between 7 a.m. and midnight on any day except Sunday and between midnight and 1:00 a.m. on Sunday.

 

                     An election is not required to allow late hours sale of alcoholic beverages.

 

                     The cities of Plano, Frisco and Allen have enacted late hours sales.

 

FINANCIAL SUMMARY: 

                     For any business applying for late night hours, an additional permit fee will be assessed by both TABC and the City of McKinney.
