ITEM SUMMARY: 

 

  • On February 26, 2018, a discussion item was presented to Council regarding potential changes to Article IV, Sections 38-70 through 38-74.
  •  
  • Since the February 26th meeting and after the March 6, 2018 primary election, staff began reviewing the operational aspects of the 2017 ordinance amendments.
  •  
  • This ordinance removes the prior-enacted designated areas for placement of political signs and limits all signs on City-owned property during all periods except during early voting and on election day. There is no limitation on the number or type of sign allowed during the voting periods. Signs are limited to 2’ x 2’ in size; however, only on those City-owned properties which serve as polling places.

  • This ordinance prohibits any electioneering within the 100’ prohibited area at polling places.
  •  
  • This ordinance prohibits vehicles within the 100’ prohibited area which displays a sign.
  •  
  • The regulations on tents, booths, tables, megaphones and those regulating the obstruction of police, fire, traffic, and patrons remain unchanged.
  •  
  • This Ordinance amends only the regulations regarding electioneering on City owned or controlled properties.

  • The Ordinance imposes a penalty, up to $500 for any person violating the rules and regulations governing electioneering, as a Class C misdemeanor.
