RECOMMENDED CITY COUNCIL ACTION:

                     Approval of the resolution.

 

ITEM SUMMARY:

                     This resolution authorizes the City Manager to amend the Texas State Soil and Water Conservation Board (TSSWCB) Project Agreement for federal funding to increase the maximum agreement amount from $351,000 to $4,500,000.

                     The primary reason for the change is to add construction funding to the agreement, which has been the intention all along.

                     This amendment also extends the term of the agreement from June 30, 2018, to June 30, 2020, to cover the entire anticipated construction period.

 

BACKGROUND INFORMATION:

                     This dam, known locally as Brinkmann Ranch Lake, is located north of US 380 between Lake Forest Drive and Hardin Boulevard. It does not meet current safety standards.  A failure of the dam would result in significant property damage and the potential loss of life.

                     City Council approved the original TSSWCB Project Agreement for federal funding at a meeting on January 3, 2017.

 

FINANCIAL SUMMARY:

                     At the time of the original agreement, it was agreed to show $0 for the estimated construction cost then amend the agreement later when actual construction costs were known.  The bid opening occurred on May 10, 2018.  The low bid amount was $4,960,863.70.  The agreement is now being amended to add construction funding.

                     The estimated project costs are as follows:

Construction:                                                               $ 5,500,000

Land Rights Acquisition:                     $    210,000

Contract Administration:                     $      40,000

Total Cost:                                                               $ 5,750,000

                     This is one of two grants for this project.  The NRCS is providing approximately $3,737,500 (65% of the overall project cost) to the TSSWCB, which is passing that on to the City by this grant.

                     The other grant is also from the TSSWCB, however, it is for state funding.  By that grant the state is funding 33.25% of the overall project. The two grants combined will fund 98.25% of the overall project.

                     The estimated City contribution for this project is $100,625 (1.75% of overall project cost).
