RECOMMENDED CITY COUNCIL ACTION:

                     Approval of Resolution.

ITEM SUMMARY:

                     This Resolution authorizes the City Manager to request the release of approximately 2.2 miles of FM 546 from the state highway system from State Highway 5 to the eastern terminus of the new FM 546 Project (TxDOT CSJ 1013-01-026).

BACKGROUND INFORMATION:

                     FM 546 runs concurrent with Industrial Boulevard for approximately 5,700 feet east of State Highway 5 / McDonald Street, and continues south and east of Industrial Boulevard an additional 5,700 feet prior to the proposed connection with the new alignment of FM 546 currently under construction.

                     TxDOT is currently finalizing construction a new alignment of FM 546 from the existing intersection of State Highway 5 and Old Mill Road to approximately 1,000 feet east of Country Lane to connect to the existing FM 546.

                     Funding for the final design, land acquisition, and construction of the new alignment of FM 546 was primarily funded by TxDOT with the City only providing a 10% local match for land acquisition ($1,187,276.10) and Regional Toll Revenue local match for construction ($216,937).

                     The City of McKinney and TxDOT have previously agreed when the new alignment of FM 546 was constructed, the existing segment of FM 546 to be replaced (including the right-of-way) would be taken off the state highway system and operated/maintained by the City for the indefinite future.

                     The section of existing FM 546 to be released from the State Highway System has been previously inspected by the Engineering and Public Works Departments and found to be in acceptable condition.

                     Prior to the section of existing FM 546 being released from the State Highway System, TxDOT has agreed to make repairs to the railroad approaches along Industrial Boulevard as well as minor asphalt pavement repairs.

                     There are various intangible benefits associated with removing the roadway from the state highway system, including:

o                     Flexibility with roadway design elements;

o                     Flexibility with setting speed limits;

o                     Flexibility with access management for adjacent properties; and

o                     Improved responsiveness to citizen/business concerns.

                     The City of McKinney has performed similar requests for release of roadways from the state highway system including:

o                     FM 3038 (Virginia Parkway)

o                     FM 543 (Trinity Falls Parkway)

o                     FM 720 (McKinney Ranch Parkway)
