RECOMMENDED CITY COUNCIL ACTION:
* Staff recommends approval of the proposed right-of-way abandonment.
ITEM SUMMARY:
* Staff received a request to abandon a portion of McDonald Street, located on the west side of McDonald Street and north of Anthony Street.
* The applicant, the Heritage Guild of Collin County, doing business as the Heritage Village at Chestnut Square, is the only adjacent property owner.
* The right-of-way consists of a triangular shaped tract containing approximately 0.033 acres.
* The right-of-way contains underground sanitary sewer facilities.
BACKGROUND INFORMATION:
* The right-of-way was originally dedicated as an alley by an undated plat for the Shorts Addition from the early 1900's.
* TxDOT acquired a portion of the alley for the construction of SH 5 in the 1950's, leaving this triangular remnant of the original alley as City right-of-way.
* TxDOT is not acquiring any additional right-of-way at this location for their planned improvements to SH 5.
* Chestnut Square has had a fence and other improvements within the right-of-way for a number of years.
* An application and supporting documentation for the requested abandonment were submitted on January 9, 2019.
* Public hearing notices were sent to all property owners within 200 feet of the requested abandonment.
* Underground sanitary sewer facilities exist within the right-of-way; a utility easement is proposed to be retained over the entirety of the abandoned right-of-way.
