RECOMMENDED CITY COUNCIL ACTION:                     

                     Appoint a member to the City of McKinney’s Capital Improvements Advisory Committee

 

ITEM SUMMARY: 

                     Section 395.058 of the Texas Local Government Code states the City of McKinney shall appoint a Capital Improvements Advisory Committee.

                     The Capital Improvements Advisory Committee advises and assists the City Council in updating and adopting land use assumptions, capital improvements plans, and impact fees.

                     The City of McKinney applies impact fees in the extraterritorial jurisdiction and therefore must include a representative from that area on the Capital Improvements Advisory Committee.

 

BACKGROUND INFORMATION: 

                     The Planning and Zoning Commission currently acts as the Capital Improvements Advisory Committee (CIAC). The CIAC is required by Chapter 395 of the Local Government Code. The Committee serves in an advisory capacity and is established to assist City Council in reviewing and adopting policies pertaining to the application of impact fees.

                     Section 395.058.(b) of the Local Government Code requires  the Capital Improvements Advisory Committee to include a representative from the extraterritorial jurisdiction if impact fees are imposed in the extraterritorial jurisdiction. The City of McKinney collects impact fees for water and wastewater in the extraterritorial jurisdiction, and is therefore required to appoint and maintain a representative from the ETJ on the CIAC.
