RECOMMENDED CITY COUNCIL ACTION:                     

                     Discuss modifications to the development process.

 

ITEM SUMMARY: 

                     Staff plans to introduce and discuss modifications to the development process which are necessitated by the State’s adoption of new legislation; specifically, HB 3167.

 

                     The primary purpose of this presentation is to alert the City Council, as well as members of the Development Community, of new processes and procedures which McKinney will implement beginning on September 1, 2019.

 

                     As previously discussed with the City Council at the July 22, 2019 work session, the 86th Texas Legislature adopted several bills which are necessitating modifications to McKinney’s existing ordinances and development process.

 

                     Specifically, three house bills of note include:

o                     HB 2439 - limits the regulation of building materials and aesthetic methods

o                     HB 3314 - modifies the public noticing requirements for replats

o                     HB 3167 - adopts a “shot clock” for plat applications (and civil engineering plans)

 

                     These house bills go into effect on September 1, 2019 necessitating McKinney’s quick implementation of modifications to existing development processes.
