RECOMMENDED CITY COUNCIL ACTION:
* Approval of the Resolution.

ITEM SUMMARY:
* This Resolution authorizes the City Manager to execute a contract in the amount of $117,860, with Freese & Nichols, Inc. for professional consulting engineering services to assist the City in completion of a Risk and Resilience Assessment as required by the America's Water Infrastructure Act of 2018, for a total aggregate contract amount, inclusive of any supplemental agreements, not to exceed $130,000.

BACKGROUND INFORMATION:
* On October 23, 2018, the America's Water Infrastructure Act (AWIA), Public Law No: 115-270 was enacted and establishes new risk and resilience requirements for Community Water Systems (CWSs).
* Section 2013 of AWIA amends Section 1433 of the Safe Drinking Water Act (from the 2002 Public Health and Bioterrorism Response Act) and requires all CWSs serving more than 3,300 people to conduct Risk and Resilience Assessments to include the risk to the system from malevolent acts and natural hazards.
* The AWIA also requires CWSs to update their Emergency Response Plans to include items that incorporate the findings of the assessment.
