ITEM SUMMARY:

                     This Resolution authorizes the City Manager to execute a contract and all necessary change orders with McKee Utility Contractors, Inc. for the construction of the Custer Road Utility Relocations Project (WA1630) for a total contract amount not to exceed $ 8,325,000.

 

BACKGROUND INFORMATION:

                     The Texas Department of Transportation (TxDOT) is in the process of finalizing the design and right-of-way (ROW) acquisition for their upcoming widening construction of Custer Road from US 380 to FM 1461 in northwest McKinney.  TxDOT has the construction letting scheduled for September 2020.

                     The Custer Road Utility Relocations Project will relocate the existing water lines to clear the proposed roadway facilities needed by TxDOT prior to their construction.

                     There is approximately 17,000 linear feet of an existing 8-inch water distribution line along Custer Road that is in conflict with the proposed TxDOT widening project.  The relocated water line will be upsized to a 24-inch water line per McKinney’s Water Master Plan.

                     The new water line will be located in a permanent water easement on the east side of TxDOT’s Custer Road ROW.

                     Lockwood, Andrews & Newnam, Inc. (LAN) prepared the construction plans for this project.

                     On Thursday, November 14, 2019, the Purchasing Department opened the Request for Competitive Sealed Proposals (RFCSP) for the project.  Eight (8) Competitive Sealed Proposals were received for Bid No. 20-13CC.

                     The RFCSP evaluation process was selected to offer the City the opportunity to evaluate the potential contractors due to the TxDOT’s time constraints and the complexity of the project.  The various components of the project include installation of a 24-inch water line, placing the new water line in operation, making all necessary connections, and removal / disposal of the existing abandoned asbestos cement (AC) water line.

                     An evaluation team comprised of three City employees and one employee from Lockwood, Andrews & Newnam, Inc. (LAN) reviewed and ranked the proposals based on the following criteria for possible maximum score of 102 points:

o                     15 Points:  Proposer’s Narrative Approach to Project

o                     15 Points:  Contractor Qualifications

o                     35 Points:  Base Bid Proposal Price

o                     30 Points:  Contractor Schedule of Calendar Days for Substantial Completion

o                     5 Points:  Contractor Safety Record

o                     2 Bonus Points:  Attendance at Pre-bid Meeting

                     McKee Utility Contractors, Inc. scored the highest total score in the categories above.  Their Base Bid Proposal Price of $7,239,441 was also the lowest proposal.

                     McKee Utility Contractors, Inc. submitted references and qualifications that were evaluated in accordance with the bid specifications as noted in the attached Letter of Recommendation from LAN dated November 22, 2019.

                     The evaluation team recommended awarding McKee Utility Contractors, Inc. the construction contract for the Custer Road Utility Relocations Project (WA1630) based on the above criteria.

                     The contract documents require that all phases of this project be substantially completed within 250 calendar days after issuance of the Notice to Proceed which is anticipated for late January 2020.  An additional 30 calendar days are allowed to reach final completion.  Final completion is estimated to be completed before the end of November 2020.

                     A higher not to exceed amount is being requested in anticipation of unforeseen utility adjustments and connection points typically encountered when dealing with the existing Danville water system along Custer Road.

FINANCIAL SUMMARY:

                     This Resolution authorizes a contract and all necessary change orders with McKee Utility Contractors, Inc. for an amount not to exceed $8,325,000.

                     With approval of this item, $1,775,499.50 will remain in the budget for WA1630.

                     The WA1630 budget includes an anticipated $3,000,000 reimbursement from TxDOT for the project.  A Standard Utility Agreement (SUA) is under review with TxDOT in order to finalize the specific reimbursement amount which is anticipated to be higher than currently estimated and will be presented to City Council when it becomes available.
