CITY COUNCIL RECOMMENDED ACTION:
* Staff recommends approval of the proposed ordinance.

ITEM SUMMARY:
* To ensure the health and safety of the residents of the City of McKinney, staff recommends changes to Chapter 94 of the McKinney Municipal Code titled Swimming Pool and Spa Operation and Maintenance.

* Current requirements of Chapter 94:
o Requires an annual swimming pool permit and a $500 fee;
o Bi-annual inspections for pools, spas, and interactive water features;
o Temporary closure(s) required when bodily fluid contaminate pool water; and
o No reinspection required or fee charged for temporary closure(s).

* Proposed additional requirements:
o Establishes requirements for a Certified Pool Operator;
o Authorizes an annual pre-season inspection;
o Requires an annual certified letter from a licensed electrician certifying all electrical equipment meets current code;
o Provides for temporary closure(s) and re-inspection for violating additional safety criteria such as:
* Water quality;
* Nonfunctional emergency phone; and
* Malfunctioning pool enclosure gates.
o Reinspection fee of $75 to re-open pool after closure;
o Late permit application fee of $200; and
o Onsite maintenance of pool quality and drain cover installation records.
