RECOMMENDED CITY COUNCIL ACTION:
Approve ordinance modifications

ITEM SUMMARY:
* The Texas Legislature has modified the provisions of the Texas Alcoholic Beverage Code regarding possession of an open container or the public consumption of alcoholic beverages.

* Proposed ordinance modifications permit possession of an open container and public consumption of alcoholic beverages.

* Restrictions still exist for City facilities, parks and parking garages - with exception of MPAC, Stars Center, Airport and Recreation Centers. Previously established consumption policies for these facilities still apply; alcohol may be consumed or sold in these facilities with proper licensing.

* Modified exemptions apply to Mitchell Park and Central Park. These parks within the Historic Downtown McKinney Cultural District are limited to beer and wine consumption only.

BACKGROUND INFORMATION:
* In response to COVID-19, the Texas Governor has issued certain orders to encourage restaurant patrons to obtain 'to-go' alcoholic beverages.
