ITEM SUMMARY:
• The City Council is seeking voter approval to sell city-owned parkland for future development. The subject property - commonly known as the Dowell Property - is a roughly 55-acre tract generally located .6-miles east of State Highway 5 and approximately .25 miles south of Harry McKillop Blvd on Couch Drive. The vacant land was purchased in 2008 for addition to the McKinney park system, which system now totals over 3,000-acres of land. The property is unimproved, and the Parks Department has no current plans to convert the land into an improved, formal park. However, plans to construct a hike and bike trail across the property will not be impacted or altered should the land be converted into another use. Under state law, proceeds from the sale of park property shall be for the exclusive use of enhancing and expanding the City’s parks system, thereby supporting existing policies to improve existing park features and acquire desirable park land.
• The Special Recall Election is to determine whether Council Member La’Shadion Shemwell will be removed from or remain in office for the remainder of his elected term, which expires May 2021. This recall election is mandated as the result of a petition, submitted by registered voters of the city, which met the requirements prescribed by state and local law.
The Ordinance provides for the following:
• Election information will be properly noticed in English and Spanish languages and in accordance with the requirements of the Texas Election Code.

• Voters can vote at any Early Voting location and Election Day Voting location administered by Collin County Elections Administration
BACKGROUND INFORMATION:
• On January 21, 2020, the City Council adopted Ordinance No. 2020-01-011 ordering a special election for Saturday, May 2, 2020.
• On March 24, 2020, the City Council adopted Ordinance No. 2020-03-023 to postpone the special election to Tuesday, November 3, 2020, in accordance with the March 13, 2020, statewide declaration of disaster due to the rapid spread of COVID-19, and subsequent suspension of certain sections of the Texas Election Code on March 18, 2020, to allow political subdivisions of the State to postpone General and Special Elections of May 2, 2020, to the next uniform election date of November 3, 2020.
FINANCIAL SUMMARY:
• The City’s cost for this Election will be approximately $70,000 including the contract with Collin County Elections Administrator to conduct the Special Election; translation services; publication and distribution of a voter’s information; advertisements; and legal notices.
• Funding for this item has been allotted in the General Fund/Non-Departmental budget account for Professional Contracted Services #001-9999-403-8516
