ITEM SUMMARY:

                     This Resolution authorizes the City Manager to execute a contract and all necessary change orders with Axis Contracting, Inc., for the Construction of the East Louisiana Street Improvements and Andrews Street and Green Street Infrastructure Improvements Projects for a total contract amount not to exceed $10,120,000.

 

BACKGROUND INFORMATION:

                     BGE, Inc. prepared the construction plans for the East Louisiana Street Improvements Project (CIP Projects ST1817, WA1817, and WW1817 - Formerly CO1817) and the Andrews Street and Green Street Infrastructure Improvements Project (ST2267, WA2267, and WW2267 - Formerly CO2067).

                     The East Louisiana Street Improvements project consists of reconstruction of East Louisiana Street from McDonald Street (SH 5) to Murray Street, including replacement of underground utilities (storm, water, and wastewater).

                     The East Louisiana Street Improvements project also includes upgrades to lighting, wider sidewalks, hardscape and landscape improvements, and a roundabout intersection at East Louisiana Street and Greenville Road.

                     The Andrews Street and Green Street Infrastructure Improvements project consists of reconstruction of Andrews Street from Greenville Road to Green Street and Green Street from the East Louisiana Public Parking Lot to South Murray Street, including replacement of underground utilities (storm, water, and wastewater).

                     Improvements will also be constructed along South Murray Street (water, storm, street resurfacing), Greenville Street (water, wastewater, storm, street resurfacing), and Throckmorton Street (storm, partial street reconstruction).

                     These combined infrastructure improvements represent the initial phase of infrastructure improvements under the East McKinney Redevelopment and Preservation efforts.

                     The City issued a Request for Competitive Sealed Proposals (22-16CSP) to solicit responses from qualified contractors for the Construction of East Louisiana St. Improvements and Andrews St. and Green St. Infrastructure improvements.

o                     1115 matching eBid Supplier Notifications which included forty-one (41) Historically Underutilized Business (HUB) suppliers.

                     Out of 1115 supplier notifications, two (2) proposals were received and opened by Procurement Services on February 28, 2022. The following is a summary of the proposals:

                     An evaluation team comprised of two (2) engineering staff members and one (1) employee from BGE, Inc. reviewed and ranked the proposals based on the following criteria:

                     Axis Contracting, Inc. scored the highest total score in the categories above (92.1/100). Their total Bid Proposal Price of $8,783,285.00 was also the lowest proposal.

                     Axis Contracting, Inc. submitted references and qualifications that were evaluated in accordance with the bid specifications as noted in the attached Letter of Recommendation from BGE, Inc. dated March 18, 2022.

                     Axis Contracting, Inc. recently completed construction of the “Light Up Louisiana” Infrastructure Improvement project in the Downtown McKinney area.

                     The evaluation team recommends awarding Axis Contracting, Inc. the construction contract for the East Louisiana Street Improvements and Andrews and Green Street Infrastructure Improvements Projects.

                     The contract documents require that this project be substantially completed within 395 calendar days after issuance of the Notice to Proceed, which is expected to be issued in April 2022. Construction is expected to be complete by June 2023.

                     Due to timing of other construction efforts in East McKinney, the contract documents include the opportunity for the contractor to receive an early completion incentive bonus of $1,000 per calendar day up to 60 calendar days if the project is completed early for specific milestones.

                     There is an accompanying item on the Council Agenda for the project authorizing a contract for materials testing.

FINANCIAL SUMMARY:

                     This Resolution authorizes a contract and all necessary change orders with Axis Contracting, Inc., for an amount not to exceed $10,120,000.

o                     $5,330,000 (52.7%) allocated towards street funding (Fund 21) from Project ST1817

o                     $790,000 (7.8%) allocated towards utility funding (Fund 20) from Project WA1817

o                     $70,000 (0.7%) allocated towards utility funding (Fund 20) from Project WW1817

o                     $2,900,000 (28.7%) allocated towards street funding (Fund 21) from Project ST2267

o                     $710,000 (7.0%) allocated towards utility funding (Fund 20) from Project WA2267

o                     $320,000 (3.2%) allocated towards utility funding (Fund 20) from Project WW2267

                     With the approval of this item and accompanying materials testing contract, the following fund balances will remain in each respective project.

o                     $573,899 will remain in Project ST1817.

o                     $60,275 will remain in Project WA1817.

o                     $63,475 will remain in Project WW1817.

o                     $89,700 will remain in Project ST2267.

o                     $5,920 will remain in Project WA2267.

o                     $50,383 will remain in Project WW2267.

                     CIP Projects ST1817, WA1817, and WW1817 (Formerly CO1817) includes $3,720,000 in Regional Toll Revenue (RTR) funds through the North Central Texas Council of Governments (NCTCOG) with a proposed modification occurring to increase RTR funds committed to $4,120,000.

                     America Rescue Plan Act (ARPA) funding may be allocated to these projects at a later date to offset other local revenues for eligible expenditures related to stormwater and utilities.
