RECOMMENDED CITY COUNCIL ACTION:                     

                     Staff recommends approval of the proposed amendment.

 

ITEM SUMMARY: 

                     Staff proposes to amend the smoking provisions of the code to expand the currently allowed use of fully-ventilated smoking rooms in private clubs to also include identically-equipped restaurants.

 

                     The proposed amendment would add restaurants with a fully ventilated smoking room to those uses identified in Section 70-182 - Places Where Smoking is Not Prohibited; however, the City’s current ventilation standards for private clubs will also apply identically to these restaurant uses.

 

BACKGROUND INFORMATION: 

                     Staff has received a request from a prominent, high-end restaurant that desires to incorporate a cigar room into their facility. If the proposed amendment is approved, restaurants desiring to allow smoking rooms would be subject to the same separate ventilation systems and related regulations that govern private clubs and private country clubs which currently utilize smoking rooms in McKinney.
