RECOMMENDED CITY COUNCIL ACTION: Staff recommends approval of the proposed Resolution terminating the Construction Manager at Risk Agreement (“CMAR Agreement”) by and between the City of McKinney, Texas and McRight-Smith, LLC, and authorizing the City Manager to execute such documents as may be necessary to terminate the Agreement according to its terms and conditions.
ITEM SUMMARY: This Resolution would authorize the City Manager to terminate the existing CMAR Agreement with McRight-Smith, LLC, dated effective as of July 26, 2020. Upon approval, City Staff will provide notice of termination to McRight-Smith in accordance with the terms and conditions of the CMAR Agreement and thereafter pursue the applicable bond for completion of the design and construction of the TKI Executive Terminal at the McKinney Airport.
BACKGROUND INFORMATION:
The City previously entered into an Agreement with McRight-Smith Construction, LLC, for Construction Manager at Risk services related to the design and construction of the TKI Executive Terminal at the McKinney Airport. For reasons not known to the City, McRight-Smith, LLC, ceased working on the project and filed for bankruptcy.
