RECOMMENDED CITY COUNCIL ACTION:

•                     Approve the ordinance. 

 

ITEM SUMMARY:                      

•                     The attached ordinance details the proposed changes to fees in the Code of Ordinances Appendix A Schedule of Fees.  These include:

o                     Changes to Alcoholic Beverage Permit Fees

o                     Development Fees Changes

§                     Planning Submittals and Resubmittals

§                     Miscellaneous Fees - ETJ Releases

•                     The new verbiage and rates in the ordinance are in blue and underlined for easier reading. Verbiage and rates to be removed are in red and have been crossed out.

 

BACKGROUND INFORMATION:

•                     Alcoholic Beverages Permit fee changes are to comply with State Legislative changes.

•                     The city cannot charge alcoholic beverage fees to businesses that are required to pay city health permit fees. This will eliminate alcoholic beverage permit fees previously collected from:

o                     all businesses permitted for the sale of alcoholic beverages for on-premise consumption (generally restaurants).

o                     businesses permitted for the sale of alcoholic beverages for off-premise consumption that are required to also obtain a city health permit (generally grocery stores, most convenience stores, and some package stores).

•                     The city fee for permit holders still subject to city fees will remain one-half of the state fee amount permit holders pay to the state.

•                     Planning submittal fees are a standard part of the development process and the revenues collected are used to support the administrative expenses associated with development. Generally speaking, submittal fees are not intended to be full cost recovery, but should be generally reflective of the administrative work and effort associated with processing and should also be generally comparable with other local processing fees. 

•                     The last time Planning submittal fees were reviewed and updated was 2022 and resubmittal fees were reviewed and updated was 2023.

•                     This is also to establish specific submittal/processing fees for ETJ releases in order to better capture the administrative costs associated with these projects.

 

SPECIAL CONSIDERATIONS:                     None.

 

FINANCIAL SUMMARY:

•                     Due to the legislative changes to the alcoholic beverage permit fees, there will be a decrease in revenue.

•                     The development fee changes are anticipated to increase revenue related to Planning Department submittals, but amounts will fluctuate with development activity.
