RECOMMENDED CITY COUNCIL ACTION:                     

•                     Staff recommends approval of the resolution authorizing the City Manager to execute an Interlocal Agreement (ILA) with Collin County Emergency Services District No. 1 (ESD No. 1) for the provision of firefighting, fire protection, and related services.

 

ITEM SUMMARY: 

•                     The proposed ILA provides for the McKinney Fire Department to continue providing firefighting, fire protection, and related services within the unincorporated area of ESD No. 1 identified in Exhibit A to the agreement.

•                     The agreement is substantially based on and mirrors of the service provisions contained in the City’s previous fire services agreement with Collin County, while transitioning the contracting entity and funding responsibility to the newly formed ESD No. 1

•                     The proposed agreement is effective October 1, 2026, and continues for six (6) months. Either party may terminate the agreement, with or without cause, upon thirty (30) days’ written notice.

 

BACKGROUND INFORMATION: 

•                     For many years, the City of McKinney and other fire departments throughout Collin County have provided fire and emergency services to portions of unincorporated Collin County under agreements with the County.

•                     Since 2013, Collin County has provided a total of $950,000 annually to participating fire departments for response services within designated unincorporated areas. Payments were allocated based on the square mileage and population of each department’s designated county fire district.

•                     The McKinney Fire Department’s designated county fire district includes the unincorporated areas within the City’s extraterritorial jurisdiction (ETJ).

•                     During FY25, the McKinney Fire Department responded to 683 incidents within its designated county fire district. Collin County paid the City $63,332 for these services, representing an average County payment of approximately $92.73 per incident.

•                     In 2025, a petition was submitted requesting the creation of Collin County Emergency Services District No. 1 under Chapter 775 of the Texas Health and Safety Code. The City Council subsequently consented to inclusion of the City’s ETJ within the proposed district.

•                     In November 2025, voters within the proposed district approved the creation of ESD No. 1 to provide fire and emergency services within portions of unincorporated Collin County.

•                     Following the formation of ESD No. 1, the District and City developed the proposed ILA to provide continuity of fire protection services while the District establishes its long-term service-delivery model.

•                     Under the proposed ILA, McKinney will continue to provide firefighting, fire protection, and related services within the designated service area, which remains the same area previously served by the City. The City will also maintain emergency-response records, coordinate with the Collin County Fire Marshal, and respond with appropriate equipment and trained personnel. The agreement otherwise carries forward the general service framework utilized under the previous Collin County agreement.

 

 

FINANCIAL SUMMARY: 

•                     Collin County Emergency Services District No. 1 will pay the City of McKinney $193,147.75 for the six-month term of the agreement. Payment is required after the District approves the fees in its FY 2026-2027 budget and no later than October 31, 2026. Funding will be paid from the District’s general fund.

•                     For comparison, under the previous Collin County agreement, the City received $63,332 for FY25 for providing fire protection services within its designated county fire district for twelve months.
