                     Staff recommends approval of the resolution.

 

ITEM SUMMARY: 

                     On February 28th, 2025, the Collin County Administrator informed the City of McKinney, Texas that The Collin County Judge has received and verified a petition on February 19th, 2025, requesting the creation of Collin County Emergency Services District (ESD) No. 1, to provide emergency services to portions of Collin County in response to any emergency in accordance with Chapter 775.

                     The petition for the proposed ESD is slated to be heard by the County Commissioner’s Court on July 21st, 2025.

                     Pursuant to Section 775.014, Texas Health and Safety Code, before an ESD may be created that contains territory in a municipality’s territorial limits or extraterritorial jurisdiction (ETJ), a written request to be included in the ESD must be presented to the municipality’s governing body.

                     The City Council has 60 days to respond to the notice of the petition, which requires action in relating to consenting to the inclusion of McKinney’s ETJ by April 19th, 2025.

                     It is estimated that the question of the creation of an ESD will be considered by the eligible voters on November 4th, 2025

 

BACKGROUND INFORMATION: 

                     The City of McKinney, Texas fire department and other fire departments throughout the county have provided life safety services to the unincorporated county for many years.

                     The county has historically paid a flat rate for these emergency services to the city, and that rate has remained the same for over a decade.

                     In the Fall of 2024, the city manager provided a notice of termination letter to the County Judge and the county administrator stating that the city would not be continuing the contract effective October 1st, 2025, and outlined the issues presented by continuing to serve the unincorporated areas.

                     Other jurisdictions in Collin County provided similar communications to the county, and as such citizens within the unincorporated county submitted a petition for the creation of an ESD.

 

FINANCIAL SUMMARY: 

                     If an ESD is established by the voters, and all eligible ETJ’s in the county are included in the ESD boundaries, it is estimated that the ESD would be eligible to collect up to $23M annually at a tax rate of $0.10/$100 of value.

                     This rate is the constitutional cap allowed by such districts in the state.
