RECOMMENDED CITY COUNCIL ACTION:                     

                     Staff recommends consideration of and action on the applicant’s appeal of the Historic Preservation Advisory Board’s action on the Certificate of Appropriateness (COA) for demolition of the building at 311 S Kentucky Street (HP2024-0057).

 

ITEM SUMMARY: 

                     The applicant proposes to demolish the building located at 311 S Kentucky Street, which requires approval by the Historic Preservation Advisory Board (HPAB).

 

                     The request to demolish the building at 311 S Kentucky Street has been considered by Staff, the HPAB and the Council several times previously, as follows:

                     HP2022-0053. COA for demolition reviewed and approved by Staff in June 2022. Approval subsequently expired and new request submitted.

 

                     HP2024-0028. COA for demolition received in May 2024 and forwarded to HPAB for consideration, along with 5 similar requests for other buildings on the master tract. HPAB considered the request at their May 2, 2024 meeting and denied the request unanimously. This action was appealed to Council at the June 18, 2024 meeting, where the Council affirmed the decision of HPAB. The Certificate of Appropriateness was denied.

 

                     HP2024-0057. COA for demolition received in September 2024 and forwarded to HPAB for consideration. HPAB considered the request at their October 3, 2024 meeting and, again, denied the request unanimously. The applicant is again appealing this decision to the Council.

 

 

 

                     Pursuant to Section 203E.6(b) of the Unified Development Code (Chapter 150 of the McKinney Code of Ordinances), if an applicant disagrees with the Historic Preservation Advisory Board, they may request that the Board’s action be appealed to the City Council. The applicant has requested such an appeal.

 

                     A copy of the Historic Preservation Advisory Board staff report, including all supporting documents, is attached to this staff report for your reference.

 

OPPOSITION TO OR SUPPORT OF REQUEST:

                     Staff has received no citizen comments in support of or in opposition to this request. This does not include emails or letters that may have been sent directly to members of the Council. Staff has not received any citizen comments through the online citizen portal.

 

BOARD OR COMMISSION RECOMMENDATION:

                     On October 3, 2024, the Historic Preservation Advisory Board voted 7-0-0 to deny the Certificate of Appropriateness.
