RECOMMENDED CITY COUNCIL ACTION:

•                     Approval of the Resolution

ITEM SUMMARY:

•                     On September 28, 2026, Aqua Texas, Inc. (Aqua), a private water utility, requested emergency water service after mechanical failures affected both wells serving the Mansions of Prosper development near Custer Road and Bloomdale Road. The development is located outside of the City’s corporate limits and not within the City’s water service area.

•                     Given the immediate need to maintain water service, the City established a temporary emergency interconnection. The City Manager and Aqua executed the Emergency Interconnection and Treated Water Supply Agreement on October 13, 2026. The proposed Resolution ratifies and confirms that prior execution.

BACKGROUND INFORMATION:

•                     On Monday, September 28, 2026, Aqua contacted Public Works after failures of both wells at its North Custer Road Plant reduced water production. Public Works coordinated an emergency connection to deliver treated water from the City’s system while Aqua repairs its wells.

•                     The temporary connection uses a City fire hydrant on Bloomdale Road, a City-owned hydrant meter and backflow prevention assembly, and temporary piping to Aqua’s facilities. TCEQ conditionally approved the interconnection on September 30, 2026, for the period needed to restore Aqua’s normal water supply.

•                     The relatively small quantity of water needed is not expected to materially affect City water system operations. Service is temporary and interruptible, with a maximum term of 120 days from September 28, 2026, under the executed agreement.

•                     Aqua is solely responsible for operation, treatment, water quality, monitoring, regulatory compliance, and customer delivery within its system after the City’s point of delivery. The City may reduce, suspend, or terminate emergency water service as needed to protect its system and has no continuing obligation to serve.

FINANCIAL SUMMARY:

•                     Aqua will pay the applicable out-of-city water rate equal to 125% of the in-city water rate, based on metered usage.

•                     Aqua must also reimburse 100% of City costs arising from the emergency interconnection and supply, including personnel, operations, equipment, administration, engineering, and legal expenses. No permanent City water service obligation is established.
