RECOMMENDED CITY COUNCIL ACTION:

ITEM SUMMARY:

                     This Resolution authorizes the City Manager to execute a supplemental agreement with Kimley-Horn and Associates, Inc. for additional professional consulting engineering services for the SH 5 Utility Relocations (Power House Street to Spur 399) Project (CIP Projects WA1633 and WW1633) for an increase in the not to exceed from $2,185,000 to a total aggregate contract amount, inclusive of any additional supplemental agreements, not to exceed $2,385,000.

 

BACKGROUND INFORMATION:

                     Kimley-Horn and Associates, Inc. is currently under contract with the City for professional consulting engineering services related to the SH 5 Utility Relocations (Power House Street to Spur 399) Project (CIP Projects WA1633 and WW1633).

                     The SH 5 Utility Relocations (Power House Street to Spur 399) Project (CIP Projects WA1633 and WW1633) consists of required relocations and betterment of existing city water distribution mains and wastewater collection mains which have been identified to be in conflict with the proposed improvements to SH 5 by TxDOT.

                     Construction of the SH 5 Utility Relocations is underway with ANA Site Construction, LLC, who is providing construction services to the City.

                     Construction of the project began on May 29, 2024, and it is expected to be completed in late 2026.

                     Almost all permanent and temporary construction easements have been acquired in areas where the space is limited for the relocated water and wastewater lines along the project limits.

                     As construction has progressed, the following additional services will be required to address insufficient funding:

o                     The construction administration task is being increased to account for issues encountered in the field during Milestone 1 as construction progresses into Milestone 2 of the project. The original funding was exhausted to address multiple Requests for Information (RFIs) and design revisions due to conflicts that were discovered during construction. Additionally, several design elements required to be refined as part of the negotiations as the City worked through the property acquisition process. Additional funding is required under this task to assist the City with change order requests, clarifications and interpretations of proposed design, shop drawing submittal reviews, etc.

o                     Due to the removal of the Lower 5 Plaza project, the design plans have to be modified to work with the design of SH 5. This also requires the preparation of additional permanent and temporary construction easements. Additional funding is required for design related to approximately 276 linear feet of 8-inch wastewater line along the west side of SH 5 between Louisiana and Virginia Streets and associated preparation of easement legal descriptions.

o                     The TxDOT Standard Utility Agreement (SUA) coordination has required more effort than was additionally anticipated. The City underwent multiple rounds of coordination with TxDOT to determine what the eligible reimbursement amounts will be. Additional funding is required under this task for final invoicing and cost reimbursement by TxDOT.

                     Construction of roadway improvements by TxDOT is expected to occur in late 2026 / early 2027, and city relocation of utility mains is expected to be substantially completed prior to commencement of TxDOT construction.

                     Kimley-Horn and Associates, Inc. submitted a proposal for $170,500.00 for the remaining additional services ($2,355,500.00 aggregate contract total), which has been reviewed by staff and exceeds the previously authorized not to exceed amount of $2,185,000.                     

 

FINANCIAL SUMMARY:

                     The Resolution authorizes a supplemental agreement with Kimley-Horn and Associates, Inc. for an increase in the not to exceed contract amount from $2,185,000 to a total aggregate contract amount, inclusive of any additional supplemental agreements, not to exceed $2,385,000.

                     With the approval of this item, $1,591,601.00 will remain in project WW1633.
