ITEM SUMMARY: The applicant is proposing a specific use permit to allow fuel sales, passenger vehicles (7-Eleven) located on Northeast Corner of Wilmeth Road and Taylor-Burk Drive

 

 

A specific use permit is required to construct a fuel sales, passenger vehicles facility on the subject property due to the fuel station being less than the required 250 feet of distance from residential use or zoning district.

SPECIFIC USE PERMITS: Pursuant to Section 203C.3.e of the McKinney UDC, the following factors should be considered when evaluating a Specific Use Permit (SUP) request: 

 

                     Whether the request complies with all site specifications adopted by the City, including the base zoning district and/or the PD entitlements;

 

                     Whether the site, buildings, and use meet the criteria specified for the use in §205C, Use Definitions and Use-Specific Standards;

 

                     Whether the proposed use will be detrimental to the adjacent properties or to the City as a whole;

 

                     Whether the proposed uses are compatible in terms of scale (building massing, form, orientation, and location), intensity, and operating characteristics with uses and structures on adjacent properties and properties in the vicinity of the proposed application; and

 

                     Whether potential impacts associated with such use are adequately mitigated through enhanced site or building design, including but not limited to additional landscaping, buffers, or screening, to minimize adverse impacts on surrounding uses and the City.

 

 

Staff have evaluated the request based on the above-mentioned parameters and feels that the site is appropriate for the proposed use.

 

A Specific Use Permit is required when a fuel pump station is located less than 250 feet from a residential use or residential zoning district within the City limits. The fuel pumps are proposed to be located approximately 233 and 227 feet from the single-family residential development to the west and south of the property.

 

However, if the HOA common areas were excluded from the distance measurement, the fuel pumps would be located approximately 250 feet from the residential lots to the south and 260 feet from the residential lots to the west. Given the distance between the fuel pumps and the surrounding residential lots, as well as the separation provided by the existing roadways and common areas, Staff finds that the fuel sale use should not negatively impact the surrounding residential development.

 

As such, Staff recommends approval of the proposed specific use permit.

 

SITE LAYOUT: The attached exhibit provides a general layout of the proposed building as well as the associated parking and internal site circulation. The site circulation, parking, and sanitation requirements are in general conformance with the Zoning Ordinance.

OPPOSITION TO OR SUPPORT OF REQUEST: Staff have received no letters of support or opposition. As part of the Planning and Zoning Commission Public Hearing, Staff has received 56 citizen comments through the online citizen portal. This does not include emails or letters that may have been sent directly to members of the Council.

 

Staff have also received an official written protest regarding the proposed specific use request on August 27th. As of August 31st, the submitted protest includes signatures from property owners representing 6.6% of the total area within 200 feet of the subject property, and does not meet the threshold for a written protest as outlined in Chapter 211.0061 of the Texas Local Government Code.

 

BOARD OR COMMISSION RECOMMENDATION: On August 25, 2026, the Planning and Zoning Commission voted 7-0-0 to table the item indefinitely and close the public hearing due to a notification error.
