RECOMMENDED COUNCIL ACTION:
• Staff recommend the City Council consider and discuss information related to ‘Vape or Smoke Shop’ land use regulations in the City of McKinney.
ITEM SUMMARY:
• The purpose of this work session item is to continue the discussion on regulating ‘Vape or Smoke Shops’ (retail establishments that specialize in selling tobacco or nicotine products and associated paraphernalia) that was begun at the June 18, 2026 City Council Work Session and continued at the September 15, 2026 Session.
• Staff has prepared options for land use changes based on feedback from Council that provide a spectrum of intensities for regulation of ‘Vape or Smoke Shops’, using a combination of allowed zoning districts, distancing buffers from sensitive uses, and the requirement of a Specific Use Permit to operate.
BACKGROUND INFORMATION:
• In February 2026, Planning staff were asked by Council to research the breadth of options available to the City in the regulation of Vape or Smoke Shops and to provide Council with their findings.
• At the June 18, 2026, City Council Work Session, Staff presented various land use options for Vape Shop regulation. Council expressed some preference for some level of distance criteria from sensitive land uses to be added for such businesses. Information regarding illegal activity, enforcement, and possible action from law enforcement was requested to understand all options.
• At the September 15, 2026 City Council Work Session, the McKinney Police Department presented additional information on enforcement against illegal activity at Vape Shops, citing the challenges and cost of testing suspected illegal products as major barriers.
