RECOMMENDED CITY COUNCIL ACTION:                     

                     Approval of the Resolution.

ITEM SUMMARY: 

                     This Resolution authorizes the City Manager to execute a contract for CMAR  services with Byrne Construction Services to provide complete preconstruction services related to McKinney Performing Arts Center Renovation Project (Project No. FC2504).

                     The selected firm, Byrne Construction Services, submitted a proposal to provide preconstruction services for an amount not to exceed $ 15,000 along with a proposed construction services fee of 2.75% of the cost of construction, for the McKinney Performing Arts Center Renovation Project. 

BACKGROUND INFORMATION: 

                     The City issued a request for qualifications (25-54CMAR) to solicit responses from qualified firms for construction of the Renovation Construction of the McKinney Performing Arts Center on June 13, 2025.

o                     Advertised in the McKinney Courier Gazette

o                     Posted on McKinney TV

o                     1,341 matching eBid Supplier Notifications which included 67 HUB supplier notifications

                     Out of 1,341 supplier notifications, ten (10) statements of qualifications (SOQs) were received on July 3, 2025.

                     A committee comprised of staff from MPAC, Public Works, and City Manager’s Office reviewed and ranked the SOQs based on the following criteria:

o                     40 Points: Firm & Individual Qualifications

o                     25 Points: Capability & Capacity to Perform Work

o                     20 Points: References

o                     10 Points: Proposed Project Schedule

o                       5 Points: Submittal Completeness and Conformance

                     Of the ten (10) firms, a total of three (3) firms were selected based on qualifications to participate in step two of the process and were requested to submit proposals including fees for the project. Proposals were received on July 25, 2025. The proposals were reviewed and ranked on the following criteria:

o                     25 Points: Proposal fees, staffing plan, project schedule, proposed bond rating, proposed general conditions.

                     Byrne Construction Services was determined to be the top-ranked firm after both steps of the CMAR selection process.

FINANCIAL SUMMARY: 

                     The Resolution authorizes the City Manager to execute a contract for Construction Manager at Risk (CMAR) preconstruction services, including potential changes to that scope of services with Byrne Construction Services for an amount not to exceed $20,000 which includes a $5,000 owner’s contingency.

                     Upon approval of this item, $173,250 will remain in project FC2504.
