RECOMMENDED CITY COUNCIL ACTION: Staff recommends disapproval of the proposed final plat due to lack of conformance with the Engineering Design Manual and the Subdivision Ordinance of the Unified Development Code.
ITEM SUMMARY: The applicant proposes to plat approximately 4.95 acres as one lot.
The proposed final plat is located within the McKinney Extraterritorial Jurisdiction (ETJ) and was originally considered by the City Council at the July 16, 2024 meeting, where it was approved with conditions. The applicant has addressed many of the conditions for approval. However, there are certain items that have not been addressed and for which the applicant is requesting variances. The variances are outlined below:
Unified Development Code (UDC):
• The applicant requests a variance to Section 307B.2. to not provide a master-planned water line easement adjacent to North McDonald Street.
• The applicant requests a variance to Section 307C.6.a. to not enter an escrow agreement for the master-planned water line adjacent to North McDonald Street.
Staff does not support the above variances because all developments are required to build utilities to and through their property. Even though the applicant doesn’t intend to tie into the master-planned line, there are properties further north that will be impacted if the easement/escrow is not provided, due to the gap that would be created.
In addition to the requested UDC variances, the applicant also requested variances to the Engineering Design Manual (EDM) which were previously denied by the Director of Engineering. With the proposed plat, the applicant is appealing this decision. The EDM variances that were denied are outlined below:
Engineering Design Manual (EDM):
• A variance to Section 2.5.A.1. to not provide a left turn lane at the median opening of North McDonald Street.
• A variance to Section 2.5.B.1. to not provide the two required right turn lanes for the driveways leading into the subject property along North McDonald Street.
The Director of Engineering is authorized and directed to apply and enforce all standards found in the Engineering Design Manual, Master Thoroughfare Plan, Stormwater Design Manual, Stream Bank Stabilization Manual, Standard Details, Construction Specifications, North Texas Council of Governments (NCTCOG) Public Works Standards and other rules and regulations adopted by the City (collectively “Requirements”) to the design and construction of public improvements in the City and in the ETJ.
Due to the speed limit and traffic volume on North McDonald Street, the Director of Engineering reviewed the variance requests and believes the required turn lanes and 36’ wide driveway are necessary for safe roadway conditions. As such, the requests were denied, and the applicant is now appealing this decision to the Council.
APPROVAL PROCESS: City Council is the final approval authority for the proposed Final Plat. Pursuant to Section 212.0091, Section 212.0093 and Section 212.0095 of the Texas Local Government Code, action on the proposed plat is final. If disapproved, any future consideration will be a new submittal following Section 212.009 (Initial Submittal).
