APPROVAL PROCESS: The recommendation of the Planning and Zoning Commission will be forwarded to the City Council for consideration at the March 31, 2025 meeting.

 

STAFF RECOMMENDATION: Staff recommends approval of the proposed amendments.

 

ITEM SUMMARY:  The purpose of these amendments is to bring Appendix 2B (McKinney Town Center MTC) into better alignment with the land uses and definitions outlined in the Unified Development Code (Chapter 150 of the Code of Ordinances) and to make corrections and other minor updates. The proposed amendments include:

 

                     Nonsubstantive editorial changes including typos, reference updates, and clarifications to various sections of Appendix 2B; and

 

                     Substantive changes to various procedures, use regulations, and development standards to Article 2 (Zoning Regulations), including Section 205 and Appendix 2B.

 

PROPOSED AMENDMENTS

 

                     Staff proposes nonsubstantive editorial changes including, typos, reference updates, and clarifications to various sections of “Section 205. Zoning Use Regulations” and Appendix 2B (McKinney Town Center MTC).

 

                     Amendments to Section 205 (Zoning Use Regulations):

o                     Remove the “Microbrewery, distillery, winery or cidery” land use and replace it with “Craft consumables”, which is inclusive of microbrewery, distillery, winery or cidery uses.

 

                     Amendments to Appendix 2B, Section 4 (Definitions):

o                     Remove definitions that are outdated, unused, or otherwise already contained in “Section 205. Zoning Use Regulations”.

 

                     Amendments to Appendix 2B, Section 6 (Schedule of Permitted Uses):

o                     Remove uses that exist on the schedule but have no corresponding allowances within the MTC;

 

o                     Bring multiple use definitions into alignment with the definitions found in “Section 205 (Zoning Use Regulations);

o                     Modify the land use permissions for “Commercial entertainment, indoor” and “Reception/event center, indoor” as follows:

§                      Allow the uses in the Downtown Edge, Transit Village Edge, and Cotton Mill Edge character districts when certain criteria are met;

§                     Allow in the Historic Core and Downtown Core character districts;

o                     Modify the land use permissions for “Commercial entertainment, outdoor” and “Reception/event center, outdoor” to allow these uses in the Downtown Edge character district with a Specific Use Permit (SUP),

 

o                     Add “Community garden” as a permitted use in all character districts and subject to additional criteria in the Historic Core character district;

 

o                     Add “Electric vehicle charging station” as a permitted accessory use in all character districts; and

 

o                     Add “Warming station” as a permitted temporary use in all character districts.

 

BACKGROUND INFORMATION: 

                     On November 15, 2022, City Council adopted an ordinance that updated the City’s development regulations as part of the New Code McKinney initiative. The initiative focused on improving and updating functionality, processes, and development standards of the code and consolidated development regulations into a single document, known as the Unified Development Code (UDC).

 

                     At that time, the existing regulations for the McKinney Town Center District were included in the UDC as “Appendix 2B: McKinney Town Center MTC” with only minor changes to minimum compatibility with the UDC and with the intention being that the MTC would later be amended to consolidate land uses and definitions with the rest of the UDC as applicable.

 

OPPOSITION TO OR SUPPORT OF REQUEST: Staff has received no letters of support to this request and no letters of opposition. This does not include emails or letters that may have been sent directly to members of the Council. As part of the Planning and Zoning Commission Public Hearing(s), Staff has not received any citizen comments through the online citizen portal.
