RECOMMENDED CITY COUNCIL ACTION:                     

                     Approval of the Ordinance.

 

ITEM SUMMARY: 

                     Several lane closures and full road closures lately have extended long beyond the timelines originally intended. As a result, staff began researching options for additional permitting and fess fees related to lane and road closures.

 

                     This Ordinance will adopt procedures and requirements for a lane closure permit and fee separate from other permits, including the authority for the Director of Engineering to specify additional requirements to minimize negative traffic impacts and to deny requested lane closures where not in the public interest.

 

                     New lane closure fees are proposed based on the number of lanes closed per day, plus an additional fee when a full road closure occurs based on the length of detour routes, as noted below:

 

o                     Lane Closure (Arterial Roadway): $500 per lane per day

o                     Lane Closure (Non-Arterial Raodway): $250 per lane per day

o                     Detours: $100 per mile per direction of detour per day

 

                     Any fee must be paid in full before implementing a lane closure based on a schedule mutually agreed between City staff and the permittee. The Ordinance provides that a partial refund in the amount of 70% of the permit fee may be issued as an incentive when the permittee meets the agreed upon schedule.

 

o                     During a presentation at City Council Work Session on December 19, 2023,  staff indicated that a full refund of the permit fee was recommended for adoption. After further consultation with the City Attorney regarding the legality of such a refund, a partial refund as noted above is instead proposed.

 

                     Escalated fees are included with this Ordinance when the agreed upon schedule is not met. Provisions for suspension of related permits are included in the Ordinance, as are provisions for completion of the work by City forces when in the public interest and recovery of any associated costs.
