Conduct a Public Hearing to Consider/Discuss/Act on the Request by Encore Wire Corporation, for Approval of a Vacation of a North/South Unimproved Right-of-Way (Bumpas Street), Approximately 0.92 Acres, Located on the North Side of Elm Street and Approximately 1,550 Feet West of Airport Drive, and Accompanying Ordinance.

RECOMMENDED CITY COUNCIL ACTION: Staff recommends approval of the proposed right-of-way vacation for Bumpas Street with the following special ordinance provisions:
1. The City of McKinney reserves an exclusive, perpetual utility easement within the entirety of the vacated right-of-way.
ITEM SUMMARY:
• The applicant is proposing to vacate an approximately 31 foot wide right-of-way that extends south from the terminus of Bumpas Street south towards Elm Street. Currently, the entire portion of this street proposed to be vacated is unimproved but public utilities do exist within the right-of-way.
• When evaluating alley abandonment or street right-of-way vacation proposals, Staff relies on the criteria outlined in the 1976 report, “Restructuring Street and Alley Space McKinney, Texas.” The reduction in the amount of street and alley space in the developed portions of McKinney located east of U.S. Highway 75 can reduce city costs and result in a more efficient use of land which could result in an improvement in the City’s revenue base. Essentially, if there is no need for the alley or street to exist, it is generally considered beneficial to abandon or vacate it. The report goes on to outline a checklist to be reviewed as a basis for each decision concerning an alley abandonment or a street vacation. The items include impact on the current and future circulation system, drainage, utilities, local access, relation to adjacent property owners, and municipal objectives and operations.
• Representatives from the Fire and Police Departments expressed concern with life safety issues should Bumpas Street be vacated without providing an alternate route to the Bumpas Street community from Elm Street. The applicant has proposed an alternate connector which would connect Bumpas Street to the built portion of Gerrish Street. The proposed alignment is shown on the associated preliminary-final plat (10-047PF) and should address the Fire and Police Department’s concerns. This future right-of-way will be constructed and dedicated by the property owner(s) via the platting process. Also, the Engineering Department indicated that public utilities currently exist within the limits of the Bumpas Street right-of-way and requests that a perpetual utility easement be retained. With that stated, all of Staff’s concerns have been addressed and Staff recommends approval of the proposed right-of-way vacation.

• Discussion: Staff has determined that the current alignment of Bumpas Street, from the built portion to Elm Street, may be vacated. However, an alternate alignment that will connect the built portion of Bumpas Street to the built portion of Gerrish Street is needed and has been reflected on an associated preliminary-final plat (10-047PF).
DRAINAGE:
• The applicant will be responsible for all drainage associated with the subject property, and for compliance with the Storm Water Ordinance, which may require on-site detention. Grading and drainage plans are subject to review and approval by the City Engineer, prior to issuance of a building permit.
