ITEM SUMMARY: 

 

                     This item authorizes the City Manager to enter into a roadway impact fee agreement with TIMBER CREEK PROPERTIES LLC, for the construction of Hardin Boulevard and Bloomdale Road, and dedication of right-of-way, generally located north of Wilmeth Road.

 

                     In conjunction with the Timber Creek Development, the applicant is required to construct two lanes of Bloomdale Road (extending approximately 3,510 linear feet), two lanes of Hardin Boulevard (extending approximately 720 linear feet), as well as intersection improvements for Bloomdale and Hardin; and to dedicate the respective rights-of-way (all of which are roadway impact fee credit eligible and shown on the attached roadway exhibit).

 

                     Due to the roadway improvements generating greater vehicle-miles of supply than necessary to serve the Phases 2B, 7A, 7B and 8 subdivisions, the City agrees to grant Developer impact fee credits in conjunction with the acceptance of the roadway improvements.

 

                     Developer has previously dedicated the right-of-way by Donation Right of Way Warranty Deed dated May 4, 2023, and recorded in the Collin County Deed Records on May 17, 2023, as Clerk’s Document No. 2023000054163.

 

                     Following the final execution of this agreement by all parties, the Developer shall receive 168.24 service units of roadway impact fee credits that will satisfy the roadway impact fee requirements for 34.69 single-family residential lots for Right-of-Way Dedication recorded on May 17, 2023.

 

                     Following the Developer’s construction of roadway segment 1 and City acceptance of the roadway improvements, the Developer shall receive 415.37 service units of roadway impact fee credits that will satisfy the roadway impact fee requirements for 86 single-family residential lots.

 

                     Following the Developer’s construction of roadway segment 2 and City acceptance of the roadway improvements, the Developer shall receive 51.74 service units of roadway impact fee credits that will satisfy the roadway impact fee requirements for 11 single-family residential lots.

 

BACKGROUND INFORMATION: 

 

                     The associated Right-of-Way dedication for the roadway improvements was recorded on May 17, 2023. An associated final plat for Timber Creek Phase 7A (PLAT2024-0171) has been approved and filed. An associated plat for Timber Creek Phase 7B (PLAT2025-0101), Phase 8 (PLAT2025-0173), and Phase 2B (PLAT2019-0108) have been approved.

 

                     The construction of roadway segment 1 is complete and awaiting final acceptance. Design of roadway segments 2 and 3 is in progress, with construction anticipated to begin upon City approval of the plans.

 

FINANCIAL SUMMARY: 

 

                     As proposed in the agreement, the construction of Roadway Segments 1 and 2 of Bloomdale Road and Hardin Boulevard, and the dedication of the associated Right-of-Way, will allow the roadway impact fees for up to 131.69 residential lots within Timber Creek Phases 2B, 7A, 7B, and 8 to be waived (estimated value of $590,497.96).
