RECOMMENDED CITY COUNCIL ACTION: Staff recommends approval of the agreement.
ITEM SUMMARY:
- This agreement will allow for the unimproved Bumpas Street right-of-way (which is located over and across the subject property owned by Encore Wire Corporation) to be vacated by the City and acquired by Encore Wire Corporation in exchange for the future dedication of right-of-way, design, and construction of the Gerrish Street extension and all related appurtenances, at the time any portion of the subject property is record platted and filed with the Collin County Clerk’s office.

- The City will retain an easement underneath the unimproved portion of Bumpas Street for sanitary sewer lines and all related appurtenances between Elm Street on the south and Bumpas Street on the north, which is more fully depicted on Exhibit A of the agreement and on the associated preliminary-final plat (10-047PF) being considered concurrently by City Council.

- Staff is supportive of the vacation of unimproved Bumpas Street (10-022AA), provided that another means of connectivity and emergency access is provided between Gerrish Street and Bumpas Street.

- If in the future an alternate alignment of proposed Gerrish Street is determined to be more appropriate, Encore Wire Corporation and the City of McKinney may agree on a new alignment and a revised plat may be submitted.

- BACKGROUND INFORMATION:

- The Bumpas Street right-of-way is currently unimproved. Currently, the City has no plans to construct Bumpas Street from it’s current terminus to Elm Street. The City of McKinney’s Police and Fire Departments have requested that if the unimproved right-of-way for Bumpas Street is vacated, then a secondary connection point between existing Bumpas Street and Gerrish Street will accommodate future access for City emergency services.

- The applicant is requesting a variance to the Subdivision Ordinance on the associated preliminary-final plat is (10-047PF), allowing the expiration date of the plat to be extended from a six-month expiration period to a fifteen-year expiration period.
