RECOMMENDED CITY COUNCIL ACTION:
• Approve proposed amendments to the Solid Waste Ordinance and Appendix A, entitled “Scheduled of Fees”
ITEM SUMMARY:
• The Solid Waste Ordinance was last updated in March 2011.
• Over the past four years the City Council has approved a Solid Waste Management Strategy and selected and contracted with a new solid waste collections vendor and recycling processing company through a Request For Proposals process.
• Updates to the Solid Waste Ordinance are required to reflect current operations and best practices.
• More specifically staff has completed a comprehensive review of the Solid Waste Ordinance and recommends changes to the Solid Waste Ordinance that reflect updates in State and Federal law, industry standards, current trends, and the City’s new franchise agreements for solid waste collection and recycling processing.
• Proposed amendments to the Solid Waste Ordinance reflect modifications that are primarily administrative in nature with the principal goal of:
o Revising and expanding definitions to coincide with the new franchise agreements.
o Outlining current operations, providing guidance on disposal options, and including enforcement actions by expanding the prohibited acts and offense clauses.
o Improving flow control for city generated solid waste and recycling materials to designated disposal or processing facilities to ensure the associated revenue stream meets enterprise fund requirements.
o Identifying Downtown Business District (DBD) services, operations, and fee structure.
• The significant changes are described herein but generally include the following:
PROPOSED SIGNIFICANT AMENDMENTS:
• Section 86-32 (Collection fees in the Downtown Business District).
o Staff has added that each utility customer or person in the DBD shall pay the fees determined by the City Council for costs associated with the shared collection system. Charges shall be billed to the utility customer(s) in each building, space, or location in the DBD
o The existing DBD rate structure (Low, Medium, High) is included in Appendix A, Schedule of Fees, which is based on the size and type of business. The uses of buildings are generally grouped together and classified as follows:
1) Service/Office Uses: Office space or service-related businesses (e.g., barber shop, travel agent, law office, small IT consulting, real estate agency).
2) Retail Uses: Businesses involving the sale of products directly to end consumers (e.g., boutique, antique shop, floral shop).
3) Restaurant Uses: Commercial establishments where food and non-alcoholic beverages are prepared and served and/or alcoholic beverages are also served (e.g., coffee shops, donut shops; sandwich shops, specialty food shops, and full-scale or limited menu restaurants;).
o The following uses are also identified as separate from the groups of classifications identified above and are analyzed separately and distinctly:
1) Hotel Uses: High regardless of square footage.
2) Church Uses: Medium regardless of square footage.
3) Residential Uses: Low rate charged per dwelling unit.
• Section 86-43 (Ownership of Solid Waste and Recyclable Materials).
o Staff has clarified that solid waste and recyclable materials placed in or adjacent to a container or cart for collection become the property of the entity that issued the container or cart.
• Section 86-44 (Door side trash and recycling cart collection assistance).
o Staff has added that a person living in a single-family residential service unit who is mobility or visually impaired, and unable to move their carts to the point of collection may request permission to place their carts just outside their front door or garage door for collection. The person shall file a request for permission to establish door side collection assistance and the person shall not be charged a fee for the application.
